 Psympl Inc. is a technology company headquartered in New York, NY. We focus on providing services that leverage cutting-edge technology to enhance user experiences.

 This Privacy Policy is applicable to Psympl Inc. (“we”, “our”, or “us”) as related to our services, which collectively include:

 the use of psympl.com, psympl.com, and various subdomains where our apps are hosted (collectively, “Website” or “Websites”), social media messages and marketing campaigns, and the use of our products and services, including Psymplifier, Consumer Console, Decoder, and Psympl Chrome Extension (together, the “Psympl Product Suite”, also referred to as the “Application” or “Services”).

This Privacy Policy sets out the essential details relating to your personal data relationships with Psympl Inc. as a: Website visitor, End-user of our Application (“End User”), Prospective client Job applicant, and Partner. Clients may contract the use of our Application and provide access to their employees and other third parties, as solely decided by them, by creating users who access the Application with their email address and credentials. Clients’ administrators grant End Users roles, which may result in different permissions and access rights to the information held in the Client account.

 

2.0 Personal information we collect

 2.1 Information you choose to provide to us

 WHEN

  • We may ask you to provide personal information when:

  •  You use our Websites to download articles, data sheets, or eBooks.

  • You use our services and applications.

  • You request a free trial or demo of our Services.

  • You refer a friend to us.

  • You connect with us directly via phone calls or video conferencing platforms.

  • We or Client account administrators grant you access to the Application.

  • You or Client account administrators upload or enter personal information into the Application.

  • You participate in a marketing or sales promotion.

  • You attend trade events and other industry networking events.

  • You register for or attend a webinar or other event.

  • You participate in programs we may offer from time to time.

  • You participate in chats with our support or sales teams.

  • You pay for our Services.

If you choose to provide us with a third party’s Personal Information (e.g., their name, email, and company) when taking part in our referral program, you represent that you have the third party’s permission to do so.

 WHAT

The personal information we collect may include your first and last name, business email address, phone number, and company name.

 As an End User of the Application, we collect your name, business email address, and any comments or content you create or make within the Application.

In addition, we may collect data uploaded by you, your employer (our Client), or other users of the Application that may be required to use Psympl Inc.'s services. We expect all users to follow their organization’s privacy policy and any applicable regulatory requirements when uploading, accessing, and using personal information within our Application. The data uploaded may include personal information like: Employee names, email addresses, titles, office locations. Vendor names, email addresses, or other personal data necessary for Psympl Inc.'s services.

Customer names and email addresses used to provide services within Psympl Inc.'s platform.

As a Job Applicant, we may also collect your resume, cover letter, and any other information you provide as part of the application process.

 

2.2 Information we collect automatically

WHEN

We collect information about your visits to our Websites and your use of our Application when you land on any of our web pages or interact with our Services, often through cookies and similar tracking technologies.

 WHAT

  • The information collected may include:

  • Access times.

  • The pages you view.

  • The links you click on.

  • The search terms you enter.

  • Actions you take in connection with any of the visited pages or Application features.

  • Your device information such as IP address, approximate location (e.g., city, country), browser type, and language.

  • The Uniform Resource Locator (URL) of the website that referred you to our Website.

  • The URL you browse away from our pages if you click on an external link.

  • We may also collect information when you open email messages from us or click on links within those email messages. 

3.0 How we use personal information

  • We use your Personal Information to:

  • Deliver the contracted Services and allow full use of the Application functionality as purchased by our Clients.

  • Deliver training and support to our Application End Users and/or carry out the transactions you have requested.

  • Communicate with you directly through emails, calls, chats, or video conferencing.

  • Send communications to you about:

  • New Application features and upgrades.

  • Our services and offerings.

  • Event announcements.

  • Product notices and changes to our terms and policies.

  • Particular programs in which you have chosen to participate.

  • Promotional offers and surveys.

  • Scheduling demos and managing free trials.

  • Carry out market research to understand how to improve our Services and their delivery.

  • Analyze user clicks and usage of the Application and Websites to improve user experience and maximize usage of our Services.

  • Manage our Websites and Application in order to maintain and deliver the contracted functionality and services.

  • Enforce our Website and Application Terms and/or separate contracts (if applicable) with you.

  • Prevent fraud and other prohibited or illegal activities.

  • Protect the security or integrity of the Websites, Application, our business, or Services; or

Otherwise, as disclosed to you at the point of collection or as required or permitted by law. Please note that sometimes we may record video conferencing calls in which you participate in order to analyze and improve our staff’s communication skills or for record-keeping of important discussions. If we do so, we will announce it at the beginning of the conference call and/or in the meeting invite, and we will provide a link to this Privacy Policy in meeting invites and on registration pages where applicable.

 We do not sell your personal information to any third party.

 

4.0 How we share personal information

Our Application and Services

If you are an End User of our Application, your personal information (such as your profile information or content you generate) may be viewed by other authorized users within your organization's account or by those with whom you explicitly share information, depending on the Application’s features and your organization’s settings.

Service Providers

We use third-party service providers (our "vendors") to help us provide and improve our Services. They will have access to your information as collected by our Websites or Application, as reasonably necessary to perform the contracted tasks on our behalf. We sign contractual agreements with these vendors to obligate them to protect the personal information, to only use it to deliver the contracted services to us, to prohibit them from selling it, and not to disclose it without our knowledge and permission.

Legal disclosures

It is possible that we may need to disclose personal information when required by law, subpoena, or other legal processes as identified in the applicable legislation.

We attempt to notify our clients about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency.

 

Change in Control

We can also share your personal data as part of a sale, merger, or change in control, or in preparation for any of these events.

Any other entity which buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.

 

5.0 How we secure personal information

We are committed to protecting the security of all of the personal information we collect and use.

We use a variety of physical, administrative, and technical safeguards designed to help protect it from unauthorized access, use, and disclosure. We strive to implement best-practice standards and controls in line with recognized security frameworks. We use encryption technologies, where appropriate, to protect data at rest and in transit.

However, please note that no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

 

6.0 Your rights

We strive to provide a consistent suite of privacy rights to all our users.

  • For personal information we have about you, subject to applicable legal requirements and limitations, you can:

  • Access your personal information or request a copy. You have the right to obtain information about what personal information we process about you or to obtain a copy of your personal information. If you have provided personal information to us, you may contact us at help@psympl.com to obtain an outline of what information we have about you or a copy of the information. If you are an End User of the Application, you can often log in to see the personal information in your account or approach your employer (our Client) for more information.

  • Be informed about our data practices. You have the right to be notified of what personal information we collect about you and how we use it, disclose it, and protect it. This Privacy Policy describes what personal information we collect and our privacy practices. We may also have additional privacy notices and statements available to you at the point of providing information to us directly.

  • Change or correct your personal information. You have the right to update/correct your personal information or ask us to do it on your behalf. You can often edit your information through your user account in the Application or ask us to change or correct it by contacting us at help@psympl.com.

  • Delete or erase your personal information. You have the right to request the deletion of your personal information at any time. We will communicate back to you within reasonable timelines the result of your request. We may not always be able to delete or erase all your personal information (e.g., if we have a legal obligation to retain it), but we will inform you of these reasons and any further actions available to you.

  • Object to the processing of your personal information. You have the right to object to our processing of your personal information for direct marketing purposes. If you object, we will stop using your personal information for these purposes. For other processing, we will consider your objection.

  • Ask us to restrict the processing of your personal information. You may have the right to ask us to limit the way that we use your personal information in certain circumstances.

  • Export your personal data. You may have the right to request that we export to you in a machine-readable format the personal information we have about you that you provided to us or that we have observed about you.

  • We do not typically process personal information through the use of solely automated means that produce legal effects concerning you or similarly significantly affect you. If we were to do so, we would provide you with information about the automated decision-making and your rights.

7.0 How long we keep your personal information

We retain information as long as it is necessary to provide the Services to you and our Clients, subject to any legal obligations to further retain such information. This includes data you provide to us and data generated or inferred from your use of our Services.

We may also retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce our Terms of Service (or other agreements), and take other actions permitted by law.

The information we retain will be handled in accordance with this Privacy Policy.

 Information connected to you that is no longer necessary and relevant to provide our Services may be de-identified or aggregated with other non-personal data to provide insights which are commercially valuable to Psympl Inc., such as statistics of the use of the Services.

 

8.0 Other Important Information

Data Processing and International Transfers

We process data primarily in the United States, where our listed vendors are located. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. We ensure that our service providers are contractually obligated to protect your data in accordance with our standards.

Lawful Bases for Processing

We will only collect and process personal data about you where we have a lawful basis for its collection. Lawful bases include:

Consent: Where you have given us clear consent to process your personal data for a specific purpose (e.g., when you visit our Websites and provide us with your personal information for a demo request, or when you opt-in to marketing communications).

Contract: Where processing is necessary for a contract we have with you (or our Client, through whom you access the Application), or because you have asked us to take specific steps before entering into a contract.

Legitimate Interests: Where processing is necessary for our legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect your personal data which overrides those legitimate interests (e.g., for operating our Services, providing support, marketing to existing contacts, or for security purposes).

As an Application End User, you typically consent to our collection of your personal information when you log in for the first time or accept terms of service. However, your employer (our Client) has control of the account and may upload and share additional personal information. It is your employer’s responsibility to ensure the collection, use, and sharing of the personal information uploaded to the Application complies with all applicable legislation.

A.1 For individuals based in California

This section provides additional specific information for consumers based in California as required by the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act ("CPRA").

A.1.1 Collection and Use of Personal Information

In the last 12 months, we may have collected the following categories of personal information (as defined by the CCPA/CPRA):

  • Identifiers: such as your name, mailing address, email address, zip code, telephone number, IP address, online identifiers, or other similar identifiers.

  • California Customer Records (Cal. Civ. Code § 1798.80(e)): such as username and password (if you create an account), company name, job title, business email address, and department.

  • Commercial Information: such as records of services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies (e.g., if you are a client).

  • Internet/Network Information: such as your Browse history, search history, log and analytics data, information about the device(s) used to access the Services, and information regarding your interaction with our websites or Services and other usage data.

  • Geolocation Data: such as information about your location (e.g., at country and city level) derived from your IP address.

  • Other Personal Information: such as personal information you provide to us in relation to a survey, comment, question, request, article download, or inquiry, and any other information you upload to our Application.

We collect personal information directly from you, from your browser or device when you visit our websites, from third parties that you permit to share your information or that share public information about you, and from our Clients (your employer, if you are an End User), as stated in Section 2.0.

A.1.2 Sharing of Personal Information

In the preceding 12 months, we may have disclosed the categories of personal information listed above to third parties for business purposes. The categories of third parties to whom we may disclose your personal information for a business purpose include: (i) our service providers and advisors (as listed in Section 4.0, e.g., Google, Amazon, Cloudflare, SquareSpace, OpenAI, HubSpot); (ii) marketing and strategic partners; (iii) analytics providers.

We do not "sell" personal information, as defined by the CCPA/CPRA, including the personal information of minors under 16 years of age. We also do not "share" personal information for cross-context behavioral advertising as defined by the CPRA.

As a California resident, you may be able to exercise the following rights in relation to the personal information about you that we have collected (subject to certain limitations at law):

The Right to Know/Access: You have the right to request any or all of the following information relating to your personal information we have collected and disclosed in the last 12 months (or longer, as permitted by law), upon verification of your identity:

  • The categories of personal information we have collected about you.

  • The categories of sources of personal information.

  • The categories of personal information that we have disclosed to third parties for a business purpose, and the categories of recipients to whom this information was disclosed.

  • The business or commercial purposes for collecting, selling, or sharing (if applicable) the personal information.

  • The Right to Request Deletion: You have the right to request the deletion of personal information we have collected from you, subject to certain exceptions (e.g., if we need to retain the information to complete a transaction, detect security incidents, or comply with a legal obligation).

  • The Right to Correct Inaccurate Information: You have the right to request the correction of inaccurate personal information that we maintain about you.

  • The Right to Opt-Out of Sales/Sharing: As stated, we do not "sell" personal information or "share" it for cross-context behavioral advertising. Therefore, there is no need to opt-out.

We will need to verify your identity before processing your request. In order to verify your identity, we will generally require sufficient information from you so that we can match it to the information we maintain about you in our systems. Sometimes we may need additional personal information from you to be able to identify you. We will notify you if this is the case.

We may decline a request to exercise these rights, particularly where we are unable to verify your identity or locate your information in our systems, or as otherwise permitted by law.

You may choose to designate an authorized agent to make a request under the CCPA/CPRA on your behalf. If you use an authorized agent, we will require verification that the agent is authorized to act on your behalf, which may include a written authorization from you and verification of your own identity.

If you are an employee/former employee of a Psympl Inc. Client that uses our application and services, please direct your requests and/or questions directly to your employer/former employer, as they are the business that controls your data in that context.

If you are a third party (e.g., auditor, business associate) who was given access to the Psympl Inc. application by a Psympl Inc. Client, please direct your requests and/or questions directly to the Psympl Inc. Client that gave you access.

 

Minors Under Age 16

Our application and services are intended for business use and we do not expect them to be of primary interest to minors. We do not knowingly collect personal information from consumers below the age of 16. As stated, we do not sell or share personal information of any consumers, including those under 16. If you believe we have inadvertently collected information from a child under 16, please contact us at help@psympl.com so we can take appropriate action.
